Frequently Asked Questions
We conduct mainly trademark searches, the most important of which are full availability searches. These provide comprehensive analysis of the Trade Marks Register in relation to a client’s proposed trademark, whether it’s a word or a logo. We also offer identical searches, proprietor searches (any registered marks owned by a particular company), and agent searches (any trademarks serviced by a particular law firm). Additionally, our multifaceted database allows for specifically tailored datasets. For example, you may wish to only search for pending applications or applications applied for within a certain period of time. Just ask, you may be surprised what we can do!
Most of our searches are requested by email, however, if you’re not sure what is required or would like to discuss the cost or strategy of your search, we are always happy to take orders by telephone. In order for us to proceed, we need some basic information. We need to know the trademark to be searched, the goods or services to be covered and how soon you would like the results. If a logo is to be searched then we need to be furnished with a clear representation which must be exactly the same as that for which registration will be sought. We will not proceed until a firm instruction has been given.
We offer three deadline protocols. Routine searches will be conducted and forwarded within 3 to 4 working days. Urgent searches are conducted and forwarded between 1 and 2 working days. ‘Express’ or expedited searches are conducted and forwarded within 24 hours. We aim to get express results to you as early as possible and so are often within 3-5 hours. Of course, this may not be possible for lists of trademarks or logo searches (which are usually quite lengthy processes).
Yes, we can conduct full searches for any logo or pictorial element. The representation given to us must be exactly as it is to be submitted for application, otherwise your results may not be entirely relevant. If your logo contains a word element, it is important to note, that although it will be taken into consideration during the search of the overall logo, the results will not constitute or equal a ‘word search’. If registered rights for the word element is to be sought then a separate word search will be required. If you are not sure how safely to proceed, we are always happy to discuss these matters on the telephone.
These searches can take anything from a few hours to a couple of days which is why they are not generally offered on an ‘express’ turnaround and are more expensive than straightforward word searches.
We have used the Marquesa Searching System for the 14 years that we have been in business. Having also used this database for a number of years prior to starting up Ingram-MacRae, I have personally used this system for nearly 25 years! We believe it to be one of the most comprehensive, reliable and user friendly systems available. Most importantly, unlike other systems, it is incredibly multifaceted and allows for a great deal of tailoring to suit one’s own purposes.
The Marquesa database is always updated swiftly and has, through the years, fully encompassed technological advances made in data collection and management. Although newcomers to the industry have been duly investigated, we remain happily with what we know best!
A UK trademark search will locate marks found on the UK Trade Marks Register, the Community Trademarks Register, the Community Designs Register, the International Register (locating only marks designating the UK) and the Reserved Words Register. These will all be searched as standard and are inclusive in the cost.
We can provide searches in almost any territory in the world. Many of these are conducted in our offices, including US Federal searches. We have a number of long standing associates who regularly conduct on our behalf, those searches we cannot do ourselves. Cost estimates can be provided, please give us a call.
Yes, UK common law searching is available. Common law searches start at £170+VAT and are turned around in 5 to 7 working days. Cost is dependent on areas to be searched so please telephone to discuss requirements and an estimate prior to instruction.
We can conduct full UK registered design searches providing a clear representation of the design is provided. We can also provide searches of the Community Design Register. It is important to note, to avoid confusion, that although the Community Design Register is searched as a matter course (and at no extra charge) during a full UK trademark search, this is to locate purely ‘trademark material’, which in recent years has become registrable on this platform, and does not constitute a design search.
We have been asked to do some odd searches over the years and are always happy to try and find a way to provide whatever information is required. Try us, remember, we don’t like to say no!
Sadly, this will rarely be the case. One of the basic rules of trademark searching is that the mark instructed should be searched ‘as a whole and as it is intended to be used and registered’. Even a slight deviation to the intended mark can often produce results which are not safe or especially relevant. It is therefore important to make doubly sure on instruction of your trademark. An example:-
BARTON, misspelt BARON
Marks which would be found by searching BARTON include BART, BUTTON, BELLARTON, CARTON and ARTEN. These may prove important but would not be located searching for BARON. Searching
BARON would unearth marks like BARONET, BORING, AARON, BARON INDUSTRIES or RON, none of which would be relevant to the actual trademark of interest.
